Gay Nigerian appeals against deportation order in Ireland.
A Nigerian man who claimed to be gay has taken the Irish authority to Court following deportation order on him.
He claimed he would be persecuted over his sexuality if deported from Ireland.
He is going to will find out later this year whether his High Court challenge to the refusal to grant him asylum is successful.
Mr Justice Seán Ryan yesterday reserved judgment on judicial review proceedings brought by Mobolaji Adams, who was deported last year after his asylum application was turned down. The judgment is not likely before October.
Mr Adams claims he left Nigeria after he was assaulted and threatened when his homosexuality was discovered. He arrived here in 2006 as an unaccompanied minor.
He claims the refusal by the Minister for Justice to revoke the deportation order took place without regard to guidelines of the UN High Commissioner for Refugees which provide that a state’s condoning of concealment of sexual orientation may amount to persecution.
Mr Adams claimed the Minister refused to revoke the deportation order on grounds that if Mr Adams practised discretion about his sexuality in Nigeria, he would not be persecuted.
